Why teams are exiting Google Drive

Files are personal data as much as email is, and usually more of it. Storing them with Google is a transfer to a US company, lawful today because of the EU-US Data Privacy Framework, which is under appeal before the court that struck down its two predecessors. The US CLOUD Act reaches data a US provider controls wherever it is stored, so a European region does not settle it. With files hosted by a Dutch company in the Netherlands there is no transfer, and Chapter V of the GDPR does not come into it.

Is Google Drive GDPR-compliant?

Today, yes, because Google is certified under the EU-US Data Privacy Framework. That compliance is as durable as the framework, and an appeal against it is pending before the Court of Justice of the EU, which struck down both of its predecessors.

We chose a European data region in Google. Is that not enough?

It decides where the files are stored. It does not decide which law Google answers to. Under the CLOUD Act a US provider must produce data under its control when a US authority orders it to, wherever that data is stored.

Can people outside our company still open what we share?

Yes. You share a file or a folder with a link, the same way you do now.

Do we have to move our email at the same time?

No, but it usually makes sense. Files and mail sit with the same provider for most companies, and the legal question is the same for both. We can do either, or both in one project.

What happens to documents people edit together in the browser?

They become ordinary office files that open in the office software on your computer. If working in one document at the same time in the browser is central to how your team works, tell us before the move so we can look at that honestly together.
